6. _____ Buyer agrees to take proper safeguards for the health, care,
and safety of said dog, including, but not limited to, vet checkups, maintenance of dog in
a fenced yard with proper shelter (including soft bedding), and the provisions of water,
Canidae All Life Stages dog food, proper exercise and BASIC OBEDIENCE TRAINING.
7.______ Buyer agrees that this dog shall NEVER ride in the back of
a pickup truck without proper legal restraints, and this dog shall NEVER be tied to any
object (such as a tree, vehicle, or fence) for restraint.
8. _____ Buyer agrees to begin a course of puppy socialization at 4
months of age and basic obedience training for the dog when it reaches 6 months of age.
Buyer shall submit to Seller documentary proof of completion of a basic course of
obedience training by twelve months of age.
If Buyer attains a Companion Dog Obedience title or Rally Obedience
title through the AKC on this dog, then $100.00 will be refunded upon the receipt of the
CD and/or Rally certificate. (This is NOT a refund for basic obedience training, but a
refund for an actual AKC title acheived by the dog)
9. _____ Buyer hereby certifies that this purchase is not made by Buyer
as agent for any other person or entity . If buyer cannot keep this dog, for any reason,
it will be returned IMMEDIATELY to Seller at Buyer's cost. Seller will locate a new home
for said dog. All expenses regarding the return, are the responsibility of the
Buyer who is returning the dog. All paperwork (AKC registration and Home Again) must
be returned with the dog and be properly signed off of. This dog may not
be placed in another home by it's current owner. If dog is returned, no monies will
be returned to Buyer.
10. _____ Said Bullmastiff is not to be trained as a guard dog or used
in any form of dog fighting. Buyer agrees to provide a safe, clean environment where
the Bullmastiff will not be subject to teasing or abuse. Should, at any time, this
Bullmastiff be mistreated, abused, or neglected by the Buyer or anyone in the care of the
Buyer, the Breeder reserves the right to take back immediate possession of this
Bullmastiff WITHOUT REIMBURSEMENT TO THE BUYER. At that time
Breeder will determine if criminal charges shall be brought forth upon the Buyer.
11. _____The Buyer agrees to notify the Breeder, and the Breeder agrees
to notify the Buyer of any change of address, email or telephone number within 2 weeks of
any change.
12._____In the event of litigation over the terms of this contract, the
cost of all legal fees will be absorbed by the party who is found at fault by the court of
jurisdiction. All disputes over articles of this contract will be determined by the
laws of the State where the Seller resides, without regard to the conflict of laws
principals. All disputes will be determined in a court of law in Breeder's venue.
13. _____The terms and conditions herein constitute the entire
agreement between the Breeder and the Buyer and supercede all previous agreements and
understandings, written or oral with respect to the subject matter hereof.
14. _____ Buyer shall supply to Seller photographs of the dog taken at
the ages of six months, twelve months, and twenty-four months.
15. _____ Buyer hereby releases and agrees to hold Seller harmless from
any and all liability for injuries or damages to person or property caused by dog while in
the possession or care of Buyer.
16. _____ Seller is not responsible for Parvo or any disease seven
days after dog has left Seller's possession and control. Buyer agrees to have
dog examined within 48 hours after possession by a licensed veterinarian. If dog is found
to have a congenital defect, the dog may be returned to Seller for a full refund of
purchase price only. If Buyer decides to keep dog, half of the purchase price will be
refunded. No travel or veterinarian expenses will be refunded.
17. _____ Aside from the foregoing, Seller makes no warranty expressed
or implied as to the fitness of the dog. Seller further makes no warranty, expressed or
implied, including, but not limited to, any unknown fitness or temperament irregularities.
The congenital, hereditary health is guaranteed until three months of age.
This Breeder does sell this Bullmastiff, believing in good faith that
the dog is a healthy and respectable compliment to its breed. We hereby acknowledge
this to be a true and binding contract. We agree, and make absolute promise, to
fully abide by its terms and conditions.
If this dog is to be owned by both parties purchasing the dog, then
both parties must sign this agreement.
